Doctors can't work under threat of being assaulted: Punjab and Haryana HC

While dismissing a plea that sought revoking of an FIR against accused charged for hurting doctors, the Punjab and Haryana High Court said that the doctors cannot function in our country if they face the threat of being attacked by the relatives of patients every day.

The bench of Justice Vikas Bahl over ruled the plea filed by Naresh Kumar and others. The petitioners were booked under Sections 147, 149, 323 and 506 of IPC in Narnaul, Mahendergarh, after a complaint filed by Civil Surgeon, Dr S N Sharma. 

Dr Sharma had complained that after the death of a patient, her relatives started making phone calls and called other persons. These people threatened to kill a doctor. Dr Sharma alleged that when the doctors of IMA reached there, the relatives attacked them.

The counsel for the petitioners stated that the FIR was lodged after two days, and no offence under Section 147 for rioting had been recognized. It was further stated that it was not clearly mentioned as to which person was beaten up. The court held that the incident has been admitted by the petitioners.

Justice Bahl held that the said persons, including the petitioners, should respect the doctors who try their best to save patients’ lives. These people should not breach the law if an unfortunate incident happens.
