In ordinary circumstances, the MCI cannot proceed with a case when the complainant has withdrawn the complaint. If some state medical council does, one can cite the above MCI judgment. However remember that any council has powers to take su moto action. If the council is convinced there is something fishy in the compromise, it may take up the case suo moto.
