Kidney removed instead of stone, patient dies

Ahmedabad: KMG General Hospital in Balasinor has been directed by the Gujarat State Consumer Dispute Redressal Commission to pay a compensation of Rs 11.2 lakh to the kin of a patient who died four months following a messed-up surgery, when the operating doctor removed the patient’s kidney instead of kidney stones, reported Saeed Khan.

The consumer court held that the hospital is liable for the negligent act of its employee - the operating doctor. It stated that the employer is accountable not just for his own acts or commission and omission, but also for the negligent acts of the employees as long as the act occurs within the course of employment.

Devendrabhai Raval had consulted Dr Shivubhai Patel of KMG hospital for severe back pain and difficulty in passing urine. In May 2011, a 14mm stone was detected in his left kidney. He underwent surgery on September 3. After the surgery, the doctor informed that instead of the stone, they had to remove the kidney. The patient’s condition eventually worsened and he died of renal complications on January 8, 2012.
