A Known Complication is not Medical Negligence

A person filed a complaint with the police alleging negligence in the treatment that was given to his wife, who later died as a result of complication of the surgery.

To rule out criminal negligence in a patient a representation was received, who developed sternal infection leading to sepsis and death after mitral valvular replacement surgery.

Treatment given is in line with the prescribed guidelines. Prima facie there is no case of medical negligence. This is a known complication of mitral valvular surgery.

Lesson: The Council found that the doctor was not guilty of negligence in the treatment given as a known complication cannot be ground for medical negligence…(order DMC/DC/F14/Comp.1079/2/2013)
