In a judgment by the Supreme Court of India, in a case titled ‘Martin F. D′Souza vs Mohd Ishfaq (3541 of 2002) dated 17.02.2009,’ Justice Markandey Katzu and G S Singhvi enlisted the precautions which doctors/hospitals/nursing homes should take: “54(c): A doctor should not merely go by the version of the patient regarding his symptoms, but should also make his own analysis including tests and investigations where necessary.”

The observation of the Hon’ble Supreme Court in this judgment clarifies that a doctor should choose investigations only if he or she feels it is necessary.
