SC orders prosecution of Bhopal Medical College Dean for perjury

The Supreme Court has ordered prosecution of Dean of RKDF Medical College in Bhopal for presenting false evidence before the court.

It was noted that the Dean had deceitfully tried to convince the court to allow the admission of 150 students in the MBBS course. The college presented fake documents and managed to get provisional permission for admitting 150 students to the second MBBS batch. The fraud came to light during the third MBBS batch, 2017-18.

The offence carries maximum punishment of seven years in imprisonment. A bench of Justices S A Bobde, L Nageswara Rao, and R Subhash Reddy also imposed a penalty of Rs 5 crore on the college, as the college had appealed in Madhya Pradesh High Court, Delhi High Court, and Supreme Court in different years challenging the report of the Medical Council of India (MCI), which had reported gross inconsistencies in the functioning of the college. The MCI recommended rejection of permission for admission to the MBBS course in 2015-16.

Senior advocate Vikas Singh and counsel Gaurav Sharma, appearing for MCI, informed the court that the college had faked documents on several occasions. The MCI inquiry had accused the faculty members of running private practice despite being on the payroll of the institution. The court caught the misconduct of the college. The college authorities presented an unconditional apology that was rejected by the court. The court barred the college from conducting admission for academic years 2018-19 and 2019-20, and imposed a penalty of Rs 5 crore, to be paid to SC Legal Aid Committee. The college was also ordered to refund the fee to the students and to pay Rs 1 Lakh in compensation to each student.
