A district consumer forum in the city has directed Aditya Hospital, Hyderabad to pay a little over Rs 12 lakh to a consumer for a failed medical procedure. A 61-year-old woman, who had undergone a Dilation and Curettage (D&C) procedure had to face serious complications due to the negligence of the gynecologist at the hospital.
K Vara Lakshmi, the complainant, submitted that she had approached and consulted a gynecologist at Aditya Hospital with a complaint of excessive white discharge and she was advised to undergo a D&C procedure. Later, she underwent the procedure on September 29, 2015 and was discharged on the same day. And was asked to come for a follow up after a week. Though, Lakshmi said that she suffered from severe abdominal pain, fever, and nausea throughout the night. In spite of taking medicine, she said that the pain continued and she was forced to visit the gynecologist the very next day after the procedure.
She said that she was diagnosed with rectosigmoid perforation with fecal peritonitis and a surgery was performed on October 1, 2015. After the surgery she went into septic shock and was put on the ventilator and later was discharged on October 19. She further said that she was also forced to undergo one more surgery for closure of ileostomy on January 10, 2016.
The doctor and hospital, in their written version, had denied any negligence in performing the D&C procedure or a failure to diagnose and give appropriate treatment. They also claimed that the complainant was stable with ‘PR-86/min, BP-120/80 mm of HG’ and there was no delay in investigations. They added that she was posted for surgery immediatelyas she was diagnosed for peritonitis.
During the trial, the bench noticed that the complainant was ‘hastily’ discharged without any necessary precautions post- procedure. They also noticed that even though the patient was admitted at 9.52 am on September 30, she was treated for laparotomy only on October 1 at 5 pm. The bench said that peritonitis is a life-threatening emergency that needs quick medical treatment. Any delay in treatment can lead to sepsis, shock, and death. In spite of being in the hospital for a whole day, there was a delay in treating her immediately for a complication that had occurred by their own negligence which is unacceptable.
