NHRC order against Apollo Hospitals, Bhubaneswar for 'illegal' kidney transplantation

Apollo Hospitals, Bhubaneswar recently issued response to a recent order of the National Human Rights Commission (NHRC) which has asked the state government to take action against the hospital for ‘illegal’ kidney transplantation.

A spokesperson of the hospital said, “The NHRC order/notification dated November 25, 2019, has been issued unfairly without giving us an opportunity for an oral hearing to present material evidence which would clear us of any culpability in the matter. The order has ignored the stay and directions issued by the Orissa High Court, and we will approach the higher courts for relief.”

Human rights activist Akhand filed the petition in January 2016 wherein he stated that the hospital had harvested kidney from Anil Swamy instead of donor Jayaram Dora, brother of Raghabram Dora (recipient). It was an illegal act. On August 8, NHRC had directed Odisha chief secretary to pay INR 2 Lakh to the victim and asked him to submit action taken report u/s 16 of the Transplantation of Human Organs and Tissues Act, 1994 with regard to suspension or cancellation of registration of the hospital.

Apollo hospital has issued a statement stating that “Apollo Hospitals has always strived to deliver the highest standards of care in an ethical and professional manner. In the aforesaid issue, we have followed the due process of rule and law. We are confident of presenting the real facts related to the case during our appeal seeking quashing of the order.”
