When is informed consent not required?

Informed consent is not required in the following situations:

  • Emergency situations, where a delay in treatment in order to obtain consent would result in harm to the patient.
  • When the patient waives the consent process.
  • If the doctor believes that the patient’s emotional and physical condition could be adversely affected by full disclosure of the treatment risks, then disclosure may be legally withheld (therapeutic privilege). However, the doctor makes sure to document the waiver.
