Kannur Medical College directed to pay compensation of Rs 40 crore by SC

On Thursday, the Supreme Court ordered the Kannur Medical College for depositing Rs 40.72 crore towards compensation for almost 92 students who are still to get compensation for the 2016-17 MBBS admissions. These admissions were cancelled for violating the norms related to the NEET-based ranking and centralized online admission system.
 
A bench that comprised Justice S Abdul Nazeer and Justice Sanjiv Khanna had ordered Kannur Medical College (KMC) to deposit Rs 15, 72, 89,020 to the admission supervisory committee (ASC) in one month with full details of students, guardians and their bank accounts. The court instructed that the ASC should distribute and make payments to the students or guardians. The order came as the appeals were considered and filed by Lalitha R Nath and 24 others that challenged the Kerala High Court’s order of 29th May 2020 putting stay on KUHS’ decision to reject the affiliation to KMC for MBBS and post-graduate courses for 2020-21.
 
The court asked the ASC to issue new notices to the remaining 92 students and examine their claims that were regarding the actual amounts (besides to government-approved fees) paid to KMC on the basis of materials that were produced by them and had passed the orders. The SC said that the orders by ASC could be challenged before the high court. The court ordered KMC to deposit Rs 25 crore to ASC and had also asked ASC to distribute the money as per the orders passed by it or the high court.
 
The court said that KMC can be entitled to claim affiliation and also give admission to the students only after they deposit Rs 15.72 crore and Rs 25 crore by filling all the statutory conditions. If they fail to make the payments as per the order that is passed by ASC and KUHS rejecting the KMC’s application for continuation of affiliation for 2020-21 and then the future academic years shall continue, as per the Supreme Court’s order.
 
The KMC is not clear with the amount of Rs 15.72 crore and the students or guardians can approach the authorities for enforcement of payment if KMC fails to deposit the money as directed by the court.
