Hiring of unqualified persons is professional misconduct

In its order DMC/DC/F.14/Comp.877/2013/dated 25th October, 2013, the Delhi Medical Council found the death of a patient was caused due to medical negligence and also found the medical director of the hospital as failing in his duties. The council cited Regulation 1.6 of the MCI Code of Ethics Regulations 2002 in its order, which states: “Every physician should aid in safeguarding the profession against admission to it of those who are deficient in moral character or education. Physician shall not employ in connection with his professional practice any attendant who is neither registered nor enlisted under the Medical Acts in force and shall not permit such persons to attend, treat or perform operations upon patients wherever professional discretion or skill is required.”
