In a judgement by the Supreme Court of India, Martin F. D’Souza vs MohdIshfaq (3541 of 2002) dated 17.02.2009, Justice Markandey Katju and GS Singhvi listed the precautions which doctor/Hospitals/Nursing Homes should take: “54(c): A doctor should not merely go by the version of the patient regarding his symptoms, but should also make his own analysis including tests and investigations where necessary.”

The observation of the Hon’ble Supreme Court in this judgement clarifies that a doctor should choose the investigations only if he/she feels it to be necessary.
