Death of a Patient While Undergoing Standard Treatment Protocol is not Negligence

A complaint was filed by a patient alleging that his wife died on the same day of the hospitalization due to the negligence in the treatment given to her in the hospital.

The patient came with intrauterine fetal demise (IUFD), sepsis and jaundice. Treatment was given as per standard treatment but the patient died within 6 hours of treatment.

The case was dismissed.

Lesson: The Council gave its decision that prima facie there was no medical negligence in this case as standard protocol was followed in the management of the patient. (In the order, DMC/DC/F14/Comp.1183/2/2013)
