SC to Centre: Look Into Suggestions to Frame Uniform Rules for Cadaveric Organ Transplant

On Monday, the apex court asked the union government to consider a plea as a representation seeking uniformity in the rules for cadaveric organ transplants across all states. The plea was heard by the bench comprising Justice DY Chandrachud and Justice P.S. Narasimha. The plea apprising the lack of uniformity in the rules regarding organ transplants was filed by an organization named "Gift of Life Adventure Foundation."

 

The plea noted that due to the lack of uniformity, some states have imposed conditions, such as that a recipient must produce a domicile certificate for a period of 10 to 15 years to be eligible for a cadaver organ transplant. They called the imposition of producing a domicile certificate for getting registered as an organ recipient "arbitrary."

 

The bench refused to entertain the plea; however, they agreed that the center and the Union Ministry of Health and Family Welfare should look into the issue of the lack of uniform rules. They added that the plea should be seen as a representation of states looking for uniformity in the Transplantation of Human Organs and Tissues Act, 1994.
