IPC Section 52: Good faith

Nothing is said to be done or believed in “good faith” which is done or believed without due care and attention. 

 

Good faith refers to genuine belief of the doctor that his act of omission or commission would be in the best interest of the patient. It is the responsibility of the defendant (doctor) to prove the good intentions and to prove that a reasonable skill and care have been exercised in discharging the duty.
