Doctor Suspended by Delhi Medical Council for Giving False Medical Certificates

A Dwarka-based private practitioner was suspended for a year by the Delhi Medical Council (DMC) for allegedly issuing a fake medical certificate to an accused to help him get interim bail from the Delhi High Court.

 

Dr. Hemant Tewari, an MD in anesthesia, allegedly provided Mr. Rambeer Shokeen with three different medical certifications in 2021, recommending urgent biopsy or removal of a sebaceous cyst and pain in the scrotum caused by a hernia. On the basis of these certificates, Mr. Shokeen applied for interim bail for a period of 45 days for medical treatment or surgery.

 

In 2015, the Delhi Police Special Cell charged Shokeen with violating Section 174 A of the Indian Penal Code and the stringent Sections 3 and 4 of the Maharashtra Control of Organized Crimes Act (MCOCA), which deal with organized crime and punishment for such offenses, respectively.

 

According to Dr. Girish Tyagi, secretary and registrar of the DMC, a doctor can only provide a medical certificate for up to 15 days. He added that many doctors in the city are engaging in this "unethical" behavior council can only take enforcement action against them in response to complaints.

 

Several officials stated that they have observed numerous instances of city-based doctors providing false certificates in the past. In 2022, Dr. Ashok Sharma, MBBS, of Shahdara was suspended for 90 days for allegedly issuing a false medical certificate of mental illness to a patient for one year without referring the patient to a psychiatrist.
