A doctor from a government hospital in Jambusar, Bharuch district, finds herself entangled in a legal battle following allegations of medical negligence. Dr Charmi Ahir has been booked under Section 338 of the Indian Penal Code after it was alleged that she left a cotton swab inside a woman during a caesarean delivery conducted in September.
Mr Shailesh Solanki, the husband of the affected woman, Mrs Amisha Solanki, lodged the complaint against Dr Ahir. Following the surgery at the sub-district hospital in Jambusar, Mrs Amisha began experiencing severe stomach pain, prompting further medical attention. Subsequent consultations revealed the presence of a cotton swab in her abdomen.
Despite Dr. Ahirs recommendation to seek treatment at SSG Hospital in Vadodara, the couple encountered difficulties there. Consequently, they opted for surgery at Yashoda Hospital in Surat on November 28 to remove the swab.
In response to the incident, Mr Solanki issued a legal notice to Dr Ahir, demanding compensation for the medical expenses. However, Dr Ahir retaliated by sending her legal notice to Mr Solanki, seeking Rs 50 lakh. She alleged defamation, citing media coverage of the incident, and claimed the accusations against her were unfounded.
The Jambusar police have investigated the matter, collecting statements from Dr. Ahir and relevant medical professionals. The legal dispute between Mr Solanki and Dr Ahir highlights the complexities surrounding medical negligence and compensation issues within the healthcare system.
