“The Supreme Court of India imposed a Rs 10 lakh fine on the National Medical Commission and dismissed its appeal against a Kerala High Court ruling, emphasizing that the NMC must act fairly and reasonably as a government body.”
The Supreme Court of India has stated that the National Medical Commission (NMC) is part of the government and should act fairly and reasonably.
The court fined the NMC Rs 10 lakh and rejected its appeal against a Kerala High Court decision. The case was about a medical college that approved increasing its student seats from 150 to 250 for the academic year 2023-24.
The NMC argued that this permission should be reviewed annually and claimed the High Court’s decision was incorrect. However, the Supreme Court disagreed, saying the NMC was not acting as a responsible party in the case. It also noted that seeking approval from multiple courts was meant to trouble the college.
The Supreme Court called the NMC's petitions a misuse of the legal process, imposed a Rs 10 lakh penalty, and ordered the amount to be paid within four weeks. Rs 5 lakh will go to the Supreme Court Advocates-on-Record Association for their library and Rs 5 lakh will go to the Supreme Court Bar Association's Advocates Welfare Fund.
