The Punjab and Haryana High Court has overturned the compensation awarded to a couple who conceived a child after a failed vasectomy. Justice Nidhi Gupta ruled that the pregnancy was not due to medical negligence but the couple's failure to exercise "due care and caution," citing a Supreme Court verdict allowing for natural conception post-sterilisation.
During proceedings, the husband dramatically compared his restraint to that of Lord Ram, invoking Sita's 'Agni Pariksha.' The HC referred to the couple's medical reports, affirming the girl born from the failed vasectomy as their daughter, removing any social stigma. The state had argued that the couple ignored post-surgery precautions.
