Supreme Court Upholds Medical Negligence Ruling, Reduces Compensation

The Supreme Court upheld the finding of medical negligence against Kamineni Hospitals and its doctor in the death of a 27-year-old, while reducing the hospitals compensation from ₹15 lakh to ₹10 lakh. The court affirmed the victims potential for future earnings by affirming the compensation.

 

On Tuesday, the Supreme Court upheld the National Consumer Commissions order holding Kamineni Hospitals and its doctor liable for the death of a 27-year-old B Tech graduate due to medical negligence. A bench of Justice B R Gavai and Justice Augustine George Masih affirmed findings by both the Andhra Pradesh State Consumer Commission and the National Commission, citing sufficient evidence.


However, the court reduced the hospitals compensation from ₹15 lakh to ₹10 lakh. The doctor, J V S Vidyasagar, accepted the decision and deposited ₹5 lakh earlier. The hospitals challenge against the consumer panels 2022 order was rejected. The court emphasized the victims potential for higher earnings, validating the compensation assessment.
